PLEDGE APP TERMS OF SERVICE

1. ACCEPTANCE OF TERMS
By downloading, installing, or using the Pledge mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Pledge ("we," "us," or "our").
2. DESCRIPTION OF SERVICE
Pledge is a mobile application designed to help users: - Set and track personal goals and pledges - Build positive habits through daily challenges - Monitor progress with streaks and achievements - Receive reminders and motivational content - Access premium features through subscription
3. ELIGIBILITY
You must be at least 13 years old (or 16 in the EEA) to use Pledge. By using the App, you represent and warrant that: - You meet the age requirement - You have the legal capacity to enter into these Terms - Your use complies with all applicable laws
If you are under 18, you confirm that you have parental or guardian consent.
4. ACCOUNT REGISTRATION
### 4.1 Account Creation To use certain features, you must create an account. You agree to: - Provide accurate, current, and complete information - Maintain and update your information - Keep your password secure and confidential - Notify us immediately of unauthorized access
### 4.2 Account Responsibility You are responsible for all activities under your account. We are not liable for losses due to unauthorized use of your account.
5. USER RESPONSIBILITIES AND CONDUCT
You agree to: - Use the App for lawful purposes only - Comply with all applicable laws and regulations - Respect other users and community standards - Provide truthful information - Not impersonate others or misrepresent your identity
6. PROHIBITED USES
You may NOT: - Violate any laws, regulations, or third-party rights - Use the App for fraudulent or malicious purposes - Harass, abuse, or harm other users - Distribute spam, malware, or viruses - Reverse engineer, decompile, or hack the App - Scrape, mine, or extract data from the App - Create multiple accounts to abuse features - Sell, transfer, or sublicense your account - Use automated systems (bots) to interact with the App - Upload offensive, defamatory, or illegal content - Interfere with or disrupt the App's operation
7. SUBSCRIPTION AND PAYMENTS
### 7.1 Subscription Plans Pledge offers subscription plans: - Pro Monthly: $1.99/month - Pro Quarterly: $4.99/3 months - Pro Annual: $9.99/year
### 7.2 Billing - Subscriptions are billed through your app store account (Apple App Store or Google Play Store) - Payment is charged upon purchase confirmation - Subscriptions auto-renew unless cancelled 24 hours before the end of the current period - You can manage subscriptions in your app store account settings
### 7.3 Free Trial If offered, free trials automatically convert to paid subscriptions unless cancelled before the trial ends.
### 7.4 Refunds Refund requests are subject to app store policies (Apple or Google). We do not process refunds directly. Contact your app store for refund requests.
### 7.5 Price Changes We reserve the right to change subscription prices with advance notice. Changes apply to new subscriptions or renewals after notice.
8. INTELLECTUAL PROPERTY RIGHTS
### 8.1 Our Content The App and all content, features, and functionality (including but not limited to design, text, graphics, logos, icons, images, audio, video, software, and trademarks) are owned by Pledge and protected by: - Copyright laws - Trademark laws - Patent laws - Trade secret laws - Other intellectual property rights
### 8.2 Limited License We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
### 8.3 Your Content You retain ownership of pledges, goals, and content you create. By using the App, you grant us a worldwide, royalty-free license to use, store, and display your content solely to provide the service.
### 8.4 Feedback Any feedback, suggestions, or ideas you provide become our property, and we may use them without compensation or attribution.
9. DISCLAIMER OF WARRANTIES
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: - Implied warranties of merchantability - Fitness for a particular purpose - Non-infringement - Accuracy, reliability, or completeness - Uninterrupted or error-free operation - Security or freedom from viruses
We do not guarantee that: - The App will meet your requirements - Results obtained will be accurate or reliable - Defects will be corrected
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLEDGE SHALL NOT BE LIABLE FOR: - Indirect, incidental, special, consequential, or punitive damages - Loss of profits, revenue, data, or use - Business interruption - Personal injury or property damage
Our total liability shall not exceed the amount you paid for the subscription in the past 12 months, or $100, whichever is less.
Some jurisdictions do not allow limitations on liability, so these may not apply to you.
11. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Pledge, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from: - Your use of the App - Your violation of these Terms - Your violation of any third-party rights - Your content or conduct
12. TERMINATION
### 12.1 By You You may terminate your account at any time through the App settings or by contacting us.
### 12.2 By Us We may suspend or terminate your account immediately, without notice, if you: - Violate these Terms - Engage in fraudulent or illegal activities - Harm other users or the App - For any other reason at our discretion
### 12.3 Effect of Termination Upon termination: - Your right to use the App ceases - Your data may be deleted - Subscription fees are non-refundable - Provisions that survive termination: Sections 8, 9, 10, 11, 15
13. MODIFICATIONS TO THE APP AND TERMS
### 13.1 App Changes We reserve the right to: - Modify or discontinue the App or features - Update content and functionality - Change subscription plans
We are not liable for any modifications or discontinuation.
### 13.2 Terms Changes We may update these Terms at any time. Changes are effective upon posting. We will notify you of material changes through: - In-app notifications - Email (if provided) - Updated "Last Updated" date
Continued use after changes constitutes acceptance.
14. PRIVACY

### 16.2 Severability If any provision is found invalid or unenforceable, the remaining provisions remain in effect.
### 16.3 Waiver Our failure to enforce any right or provision is not a waiver of that right.
### 16.4 Assignment You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.
### 16.5 Force Majeure We are not liable for delays or failures due to circumstances beyond our reasonable control.
### 16.6 Third-Party Beneficiaries No third parties have rights under these Terms.

19. EXPORT COMPLIANCE
You agree to comply with all export and import laws and regulations. You may not use the App in countries subject to embargo or export restrictions.
